NxtLvl.chat – Terms of Use

1. Acceptance of Terms
By downloading, installing, or using NxtLvl.chat (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.
2. Description of Service
NxtLvl.chat is a secure, end-to-end encrypted messaging application that allows users to:

• Send and receive encrypted text messages and images
• Create and participate in encrypted group chats
• Store private content in an encrypted vault

• Manage contacts through QR code exchanges
• Send self-destructing messages with configurable burn delays

3. Privacy and Data Security

3.1 End-to-End Encryption

• All messages are encrypted using military-grade end-to-end encryption (E2EE) with industry-standard cryptographic protocols
• We cannot read, access, or decrypt your messages
• Encryption keys are generated and stored locally on your device
• Key exchanges occur securely between users to establish encrypted communication channels

3.2 Local Data Storage

• Messages, contacts, and vault items are stored locally on your device in encrypted format
• Your data is protected by the password or biometric authentication you set
• We do not have access to your local encryption password or keys

3.3 Server Data

• Only encrypted message payloads are transmitted through our servers
• We cannot access the content of your encrypted messages
• Metadata (such as timestamps and delivery status) may be temporarily stored for message delivery
• Self-destructing messages are automatically deleted from servers according to your configured retention

3.4 Push Notifications

• The App uses OneSignal for push notifications
• Notification does not transmit message contents
• You can disable push notifications in your device settings

4. User Responsibilities

4.1 Account Security

• You are responsible for maintaining the security of your password and biometric authentication
• You must not share your password with others
• You are responsible for all activities that occur under your account
• If you lose access to your password, you may lose access to your encrypted data permanently

4.2 Acceptable Use

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Transmit illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Impersonate any person or entity
• Transmit spam, unsolicited messages, or chain letters
• Distribute malware, viruses, or harmful code
• Interfere with or disrupt the App’s functionality
• Attempt to breach security or authentication measures
• Use the App for any commercial purpose without authorization

4.3 Content Responsibility

• You are solely responsible for the content you send through the App
• You retain all rights to your content
• You must have the necessary rights to share any content you transmit
• We are not responsible for monitoring or moderating user content due to end-to-end encryption

5. Age Requirements
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you confirm that you have parental or guardian consent to use the App.

6. Intellectual Property

6.1 App Ownership

• The App and all intellectual property rights remain the property of NxtLvl.chat
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal use
• You may not copy, modify, distribute, sell, or reverse engineer the App

6.2 User Content

• You retain ownership of content you create and share through the App
• By using the App, you grant us a limited license to transmit and deliver your encrypted content
• This license is solely for providing the service and does not grant us access to decrypted content

7. Disclaimer of Warranties

IMPORTANT LIMITATIONS:

7.1 “AS IS” Service
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or availability of the service
• Security or uninterrupted operation
• Freedom from errors, bugs, or vulnerabilities

7.2 No Guarantee of Security

While we implement strong encryption and security measures:

• No system is 100% secure
• We cannot guarantee absolute protection against all threats
• You use the App at your own risk
• You are responsible for backing up important data

7.3 Data Loss Risk

• If you lose your password, your encrypted data cannot be recovered
• We cannot recover lost passwords or encryption keys
• Device loss, damage, or malfunction may result in data loss
• Self-destructing messages are permanently deleted and cannot be recovered
• if you reset or lose your device or password, all vault items will be permanently lost. It is strongly recommended that you maintain a manual backup at all times.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid to use the App (if any)
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

9. Indemnification

You agree to indemnify, defend, and hold harmless NxtLvl.chat, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you transmit through the App

10. Service Modifications and Termination

We reserve the right to:

• Modify, suspend, or discontinue the App at any time without notice

• Refuse service to anyone for any reason
• Terminate or suspend accounts that violate these Terms

10.2 Your Rights

You may stop using the App at any time by:

• Uninstalling the App from your device
• Deleting your account through the App settings

• Upon termination, your right to use the App ceases immediately
• You may lose access to your data

3. Self-Destruct is Permanent: Messages with burn delays are permanently deleted and cannot be recovered by you or us.
